There are two functions of labor law: economic function and social function. The former deals with employer’s interests and the latter deals with employee’s interests. These interests are opposed to each other in many aspects; therefore the most difficult issue is to balance them in both statutes and common law. Realization of labor law functions in modern economic and social conditions calls for new ways. Legislatures and courts do not only apply traditional approaches but establish new ones. The main factor that they take into account is the need to balance interests of employers and employees. UK and US steps in this area are one of the best attempts to achieve this complex goal. Their approaches agree with conventions and recommendations of ILO
